Real Estate Litigation

Graubard Miller represents real estate owners, agents, developers, landlords, tenants, and investors in a wide range of disputes. Our real estate litigation practice encompasses complex issues before various state and city administrative agencies that regulate property and housing such as the New York State Division of Homes and Community Renewal (DHCR), the New York City Department of Housing Preservation and Development (HPD), the New York City Board of Standards and Appeals (BSA) and the New York State Division of Human Rights (DHR), among others. We also challenge agency determinations in the courts.

Some of the matters we address include demolition applications, luxury deregulation,  hardship applications, rent overcharge and service complaints. We also counsel clients on rent regulatory issues relating to tax benefit programs such as J-51 and RPTL 421-a.

Specific performance actions

Our landlord-tenant practice encompasses commercial and residential holdover proceedings on issues including options to renew, illegal subletting, owner occupancy, rent regulation coverage and succession among others. We represent owners and tenants in commercial nonpayment and holdover proceedings, Yellowstone injunctions, and contract and lease disputes in the New York State Supreme Court, New York City Civil Court, and all appellate courts.
